1. Provider information
This website and the accommodation service are provided by Los Lagos Hotel, located at 25 de Mayo 220, Z9405 El Calafate, Province of Santa Cruz, Argentine Republic. Contact: info@loslagoshotel.com.ar / +54 2902 417738.
2. Purpose
These Terms and Conditions govern the relationship between Los Lagos Hotel and the guest regarding the booking and provision of the accommodation service, in accordance with Consumer Protection Law 24,240 and the Civil and Commercial Code of Argentina (Law 26,994).
3. Booking and confirmation process
Bookings can be made through the online booking engine (managed by Cloudbeds), by email, or by phone. A booking is considered confirmed once the guest receives a written confirmation from the hotel. The hotel reserves the right not to confirm a booking without stating any cause, in which case it will immediately refund any amount that may have been paid.
4. Prices, currency, and billing
Published prices are stated in Argentine pesos (ARS) or US dollars (USD) as indicated during the booking process. For foreign tourists who are not residents of the Argentine Republic, the differentiated rate set out in the regulations in force from the Central Bank of the Argentine Republic (BCRA) may apply. The hotel will issue the corresponding invoice in accordance with AFIP requirements. Prices include the national and provincial taxes in force, unless expressly stated otherwise.
5. Cancellation policy
The specific cancellation conditions are provided at the time of booking and vary according to the rate selected:
- Flexible rate: free cancellation up to 72 hours before the scheduled check-in date.
- Non-refundable rate: no right to a refund in the event of cancellation, modification, or no-show.
In all cases, the hotel will refund the corresponding amounts within the timeframes set out by Law 24,240 and its amendments.
6. Right of withdrawal (Art. 34, Law 24,240)
A guest who has contracted remotely (via internet, email, or phone) has the right to withdraw their acceptance within 10 (ten) business days from the date the booking was confirmed, without any liability and without stating a cause, provided that the check-in date is not imminent and performance of the contract has not begun. To exercise this right, the guest must notify the hotel by email or by phone.
Once that period has elapsed, the cancellation policy described in section 5 will apply.
7. Check-in and check-out
- Check-in: from 2:00 PM. A valid ID (national ID or passport) will be requested upon arrival, in accordance with the guest registration regulations in force.
- Check-out: until 10:00 AM. Staying beyond that time may be billed as an additional night.
- An advance deposit or the full amount of the booking may be required at check-in as a guarantee.
8. Guest obligations
- Present a valid ID at check-in.
- Use the facilities in a responsible and respectful manner.
- Smoking is prohibited inside the rooms and enclosed common areas, in accordance with Anti-Tobacco Law 26,687.
- The guest will be liable for any material damage they cause to the hotel facilities, which may be billed before check-out.
- Any external visitors entering the rooms must be reported to reception.
9. Liability
The hotel is not liable for the loss, theft, or damage of valuables that have not been placed in the safe available in the rooms or at reception. Guests are advised to use the safekeeping facilities provided for this purpose.
The hotel will not be liable for any failure to perform arising from force majeure or unforeseeable events (including, without limitation, natural disasters, public utility outages, acts of public authority, or emergency situations) in accordance with articles 1730 and 1731 of the Civil and Commercial Code of Argentina.
10. Intellectual property
All content on this website (text, images, logos, design) is the property of Los Lagos Hotel or its licensors, and is protected by Intellectual Property Law 11,723. Its reproduction, distribution, or public communication without express authorization is prohibited.
11. Dispute resolution
In the event of any problem, the guest may contact the hotel directly. If a satisfactory solution is not reached, the consumer may turn to:
- National Consumer Protection Directorate (DNDC): COPREC online dispute resolution system: www.argentina.gob.ar/defensadelconsumidor.
- Consumer Protection Office of the Province of Santa Cruz (local jurisdiction).
12. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Argentine Republic. For the resolution of any dispute, the parties submit to the jurisdiction of the Ordinary Courts of the city of El Calafate, Province of Santa Cruz, expressly waiving any other venue or jurisdiction that may apply, without prejudice to the rights granted to the consumer by Law 24,240 and its amendments.
13. Amendments
The hotel reserves the right to amend these Terms and Conditions at any time. Changes will be published on this website with an indication of the date of the last update. Bookings already confirmed will be governed by the terms in force at the time of their confirmation.
